1. Introduction and Acceptance of Terms

Welcome to Hytale Tracker ("we," "us," "our"), a Hytale player lookup and profile platform operated by Lucid ICT Limited, a company registered in Scotland (Company Number: SC760973) with its registered address at Suite 2/3, 48 West George Street, Glasgow, Scotland, G2 1BP.

These Terms of Service ("Terms") govern your access to and use of the Hytale Tracker website located at hytaletracker.org (the "Site") and all related services, features, and content (collectively, the "Service").

By accessing or using the Service, you agree to be bound by these Terms. If you do not agree to these Terms, you must not access or use the Service.

2. Definitions

  • "User" refers to any individual who accesses or uses the Service, including visitors, registered users, and subscribers.
  • "Account" refers to a registered user profile on our platform, created through Discord authentication.
  • "Profile" refers to a Hytale player profile displayed on our platform, including player model, name history, and associated data.
  • "Linked Account" refers to a Hytale account that a User has connected to their Hytale Tracker Account.
  • "Content" refers to any text, images, graphics, player data, or other materials displayed on or submitted to the Service.
  • "Subscription" refers to a paid membership plan that provides access to premium features on the platform.
  • "Subscriber" refers to a User who has an active paid Subscription.

3. Eligibility

3.1 You must be at least 13 years of age to use the Service. If you are between 13 and 18 years of age (or the age of majority in your jurisdiction), you may only use the Service with the consent of a parent or legal guardian who agrees to be bound by these Terms.

3.2 By using the Service, you represent and warrant that you meet the eligibility requirements and have the legal capacity to enter into these Terms.

3.3 We reserve the right to request proof of age or parental consent at any time and to suspend or terminate accounts that do not meet these requirements.

4. Account Registration and Discord Authentication

4.1 To access certain features of the Service, you must create an Account by authenticating through Discord. By doing so, you authorise us to access certain information from your Discord account as permitted by Discord's terms and your privacy settings.

4.2 You are responsible for maintaining the security of your Discord account, which controls access to your Hytale Tracker Account.

4.3 You must notify us immediately of any unauthorised access to or use of your Account.

4.4 We reserve the right to suspend or terminate Accounts that violate these Terms or that we reasonably believe pose a security risk.

4.5 You may not create multiple Accounts or use another person's Discord account to access the Service without their permission.

4.6 We are not responsible for any issues arising from Discord's services, including authentication failures, account suspensions, or changes to Discord's platform.

5. Linking Your Hytale Account

5.1 The Service allows you to link your Hytale account to your Hytale Tracker Account to access additional features and claim your Profile.

5.2 You may only link Hytale accounts that you own or have explicit authorisation to use. Linking another person's Hytale account without their permission is strictly prohibited.

5.3 By linking your Hytale account, you consent to us accessing and displaying information associated with that account, including your player model, username, name history, and other publicly available data.

5.4 You may unlink your Hytale account at any time through your Account settings, subject to any technical limitations.

5.5 We are not responsible for any issues arising from Hytale's services or any changes to the availability of Hytale account data.

6. Player Profiles and Data

6.1 The Service displays player Profiles containing information such as player models, usernames, name history, and other data obtained from Hytale or submitted by Users.

6.2 Profile information is generally publicly viewable. By using the Service and linking your Hytale account, you acknowledge that your Profile information may be visible to other Users.

6.3 We make reasonable efforts to ensure the accuracy of Profile data, but we do not guarantee that all information is complete, current, or error-free.

6.4 If you believe that a Profile contains inaccurate information or infringes on your rights, please contact us using the details provided in Section 19.

6.5 We reserve the right to remove, modify, or restrict access to any Profile at our sole discretion.

7. Subscriptions and Payments

7.1 Subscription Plans: We offer paid Subscription plans that provide access to premium features, including but not limited to ad-free viewing and enhanced functionality. The specific features, pricing, and duration of each Subscription plan are detailed on our website at the time of purchase.

7.2 Payment: By purchasing a Subscription, you agree to pay all applicable fees at the prices in effect at the time of purchase. Payment must be made using one of the accepted payment methods specified on the platform.

7.3 Billing Cycle: Subscriptions are billed on a recurring basis according to the billing cycle you select (e.g., monthly, annually). Your Subscription will automatically renew at the end of each billing cycle unless you cancel before the renewal date.

7.4 Automatic Renewal: By subscribing, you authorise us to charge your chosen payment method automatically at the start of each billing cycle. You may cancel automatic renewal at any time through your Account settings.

7.5 Price Changes: We reserve the right to change Subscription prices at any time. Price changes will take effect at the start of your next billing cycle following notice of the change. Your continued use of the Subscription after the price change constitutes your acceptance of the new price.

7.6 Cancellation: You may cancel your Subscription at any time through your Account settings. Upon cancellation, your Subscription will remain active until the end of the current billing period, after which it will not renew and premium features will no longer be available.

7.7 Refunds: Subscription payments are generally non-refundable. Refunds may be issued at our sole discretion in exceptional circumstances. If you are a consumer in the United Kingdom or European Union, you may have a statutory right to a refund within 14 days of purchase if you have not used the premium features, in accordance with the Consumer Contracts Regulations 2013.

7.8 Free Trials: We may offer free trial periods for Subscriptions. At the end of a free trial, your Subscription will automatically convert to a paid Subscription unless you cancel before the trial ends. We will notify you before any charges are applied.

7.9 Account Standing: We reserve the right to suspend or terminate Subscriptions for Accounts that violate these Terms. No refund will be provided for Subscriptions terminated due to a violation of these Terms.

7.10 Taxes: Subscription prices may or may not include VAT or other applicable taxes, as specified at the time of purchase. You are responsible for any taxes applicable to your purchase.

8. Acceptable Use

8.1 You agree not to use the Service to:

  • Violate any applicable laws or regulations
  • Infringe on the rights of others, including privacy rights
  • Attempt to access Profiles or data you are not authorised to view
  • Scrape, harvest, or collect data from the Service using automated means without our express written permission
  • Attempt to gain unauthorised access to our systems or other users' Accounts
  • Interfere with or disrupt the Service or servers connected to it
  • Circumvent, disable, or interfere with security features of the Service
  • Use the Service to harass, stalk, or harm other Users
  • Impersonate any person or entity or falsely claim affiliation with any person or entity
  • Use the Service for any commercial purpose without our express written permission
  • Engage in spam, phishing, or other deceptive practices

8.2 We reserve the right to investigate and take appropriate action against anyone who violates these provisions, including removing Content, suspending or terminating Accounts, and reporting to law enforcement authorities.

9. Intellectual Property

9.1 Our Rights: The Service, including its design, features, functionality, and all associated intellectual property rights, is owned by Lucid ICT Limited or its licensors. You may not copy, modify, distribute, or create derivative works based on our Service without express written permission.

9.2 Hytale Content: Player models, usernames, and other Hytale-related content displayed on the Service are the property of Hypixel Studios or their respective owners. We display this content for informational purposes and do not claim ownership of it.

9.3 Third-Party Rights: "Hytale" is a trademark of Hypixel Studios. "Discord" is a trademark of Discord Inc. Hytale Tracker is an independent platform and is not affiliated with, endorsed by, or sponsored by Hypixel Studios, Discord Inc., or any of their affiliates.

9.4 User Submissions: If you submit any content to the Service (such as comments or feedback), you grant us a non-exclusive, worldwide, royalty-free licence to use, display, reproduce, and distribute such content in connection with operating and promoting the Service.

9.5 Copyright Complaints: If you believe that content on our Service infringes your copyright, please contact us with the following information:

  • A description of the copyrighted work
  • The location of the allegedly infringing material on our Service
  • Your contact information
  • A statement of good faith belief that the use is not authorised
  • A statement, under penalty of perjury, that the information is accurate and you are authorised to act on behalf of the copyright owner

10. Privacy and Data Protection

10.1 Your privacy is important to us. Our collection and use of personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference.

10.2 By using the Service, you consent to the collection, use, and sharing of your information as described in our Privacy Policy.

10.4 By linking your Hytale account, you consent to the processing and public display of associated player data as described in these Terms and our Privacy Policy.

11.1 The Service may contain links to third-party websites, services, or content that are not owned or controlled by us.

11.2 The Service integrates with third-party services, including Discord for authentication and Hytale for player data. We are not responsible for the availability, accuracy, or practices of these third-party services.

11.3 We have no control over and assume no responsibility for the content, privacy policies, or practices of any third-party websites or services.

11.4 You acknowledge and agree that we shall not be responsible or liable for any damage or loss caused by or in connection with use of any third-party websites or services.

12. Disclaimers

12.1 THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

12.2 We do not warrant that:

  • The Service will be uninterrupted, secure, or error-free
  • Player data and Profiles will be accurate, complete, or current
  • The results obtained from using the Service will be accurate or reliable
  • Any errors in the Service will be corrected

12.3 We do not guarantee the availability of Hytale account data or the continued operation of any third-party services on which the Service depends.

12.4 Premium features provided through Subscriptions are subject to availability and may change over time.

13. Limitation of Liability

13.1 TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, LUCID ICT LIMITED AND ITS DIRECTORS, EMPLOYEES, AGENTS, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE.

13.2 IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS OR YOUR USE OF THE SERVICE EXCEED THE AMOUNT YOU HAVE PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR ONE HUNDRED POUNDS (£100), WHICHEVER IS GREATER.

13.3 Nothing in these Terms excludes or limits our liability for:

  • Death or personal injury caused by our negligence
  • Fraud or fraudulent misrepresentation
  • Any other liability that cannot be excluded or limited under applicable law

14. Indemnification

14.1 You agree to indemnify, defend, and hold harmless Lucid ICT Limited and its directors, officers, employees, agents, and affiliates from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising out of or in connection with:

  • Your use of the Service
  • Your violation of these Terms
  • Your violation of any rights of a third party
  • Any content you submit to the Service
  • Your linking of a Hytale account you are not authorised to use

15. Modifications to the Service and Terms

15.1 We reserve the right to modify, suspend, or discontinue the Service (or any part thereof) at any time, with or without notice. This includes the right to modify, add, or remove premium features available to Subscribers.

15.2 We may revise these Terms from time to time. The most current version will always be posted on this page with the "Last Updated" date.

15.3 Material changes to these Terms will be communicated through the Service or by other means we deem appropriate.

15.4 Your continued use of the Service after any changes constitutes your acceptance of the revised Terms.

16. Termination

16.1 We may terminate or suspend your access to the Service immediately, without prior notice or liability, for any reason, including if you breach these Terms.

16.2 You may terminate your Account at any time by contacting us or using the account deletion feature if available.

16.3 Upon termination:

  • Your right to use the Service will cease immediately
  • We may delete your Account and any associated data
  • Any active Subscription will be cancelled without refund if termination is due to a violation of these Terms
  • Provisions of these Terms that by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, indemnification, and limitations of liability

17. Governing Law and Dispute Resolution

17.1 These Terms shall be governed by and construed in accordance with the laws of Scotland and the United Kingdom, without regard to conflict of law principles.

17.2 Any disputes arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of Scotland.

17.3 If you are a consumer, you may also be entitled to use the European Commission's Online Dispute Resolution platform, available at https://ec.europa.eu/consumers/odr.

18. General Provisions

18.1 Entire Agreement: These Terms, together with our Privacy Policy and any other legal notices published on the Service, constitute the entire agreement between you and Lucid ICT Limited regarding your use of the Service.

18.2 Severability: If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

18.3 Waiver: Our failure to enforce any right or provision of these Terms shall not be deemed a waiver of such right or provision.

18.4 Assignment: We may assign or transfer these Terms, in whole or in part, without restriction. You may not assign or transfer any of your rights or obligations under these Terms without our prior written consent.

18.5 Notices: Any notices or communications from us will be provided via the Service, email, or other means we deem appropriate.

18.6 Force Majeure: We shall not be liable for any failure or delay in performing our obligations under these Terms due to circumstances beyond our reasonable control, including but not limited to acts of God, natural disasters, war, terrorism, strikes, or government actions.
